When a storm passes by the area, it’s vital that homeowners have their roofing systems inspected as soon as possible. Unfortunately, some homeowners opt out of this task for one reason: they don’t see any leaks. According to experts, however, an inspection after a storm is essential. Video: New Law Makes Waiving Insurance Deductibles Illegal
According to a new state law, roofing contractors can no longer waive insurance deductibles. This measure aims to protect consumers from contractor fraud.
Texas Traditions Roofing, a trusted expert in roof replacement, shares more details about this legislation.
A New Law That Curbs Roof Scams
Waiving deductibles is a way for unscrupulous roofing contractors to cut corners. They usually offer to waive the deductibles or absorb the homeowner’s deductible as a selling point. However, this often leads to roofers using lower-quality products or inflating the bill sent to the insurance company.
With the new state law, contractors or roofers can no longer waive a deductible or promise their customers a rebate for a deductible. Those who do will be found guilty of violating this law and could get up to a $2,000 fine and six months in jail.
Tips to Avoid Scams
Whether you’re hiring a roofer to carry out a simple roof repair or a complete roof replacement, it’s best to take the following precautions:
-
Ask for a detailed estimate. Make sure it’s written on company letterhead with the company’s contact information.
-
Check the contracts for blanks, and never sign an agreement with blanks on it.
-
Compare quotes from different businesses so that you can get a better idea of what’s a reasonable price for your job.
-
Verify company information and contact details.
-
Be wary of roofers who only have references from outside your area. Also, be cautious when dealing with contractors who solicit door to door.
-
Don’t pay the full costs upfront. Wait until the job is done.

How to Avoid Roofing Scams and Storm Chasers
Texas is the only Gulf state with no protections for consumers against roofing scams. Over the last decade, efforts have been made to regulate the roofing industry. However, every attempt has unfortunately died in the legislature.

No More Waiving Deductibles for Roof Claims in Texas
For the last 30 years, it’s become more common for homeowners to be duped into committing insurance fraud through a roofing contractor’s promise of a free roof or a waived deductible. A statute was passed in 1989 to end this practice but it was poorly worded, rarely enforced and largely ignored by contractors. Continue reading “No More Waiving Deductibles for Roof Claims in Texas”
